
Udita is a Partner in the Litigation Team of Anand and Anand, with over 12 years’ of experience in IP Litigation. She has been involved in successful campaigns for pharmaceutical companies and agrochemical companies, well-known luxury brands, FMCG companies, famous celebrities, etc.
Community Involvement
Udita is part of a team which regularly handles pro-bono litigation work for various artists. During the Covid lock-down she worked as a part of the team which successfully restrained sale of counterfeit face masks of well-known brands.
She also helps with the firm’s bi-annual caselaw update feature ‘HIGHLIGHTS’, which aims at providing working summaries of the decisions passed by the Intellectual Property Division of the Delhi High Court.
Some major decisions passed by Indian Courts, where she was a part of the team representing the successful litigant, include:
- Merck Sharp & Dohme v Glenmark – first patent infringement case in India which was decreed in favour of the Plaintiff patentee after trial.
- Monsanto v Nuziveedu – Case before the Supreme Court of India involving patent eligibility under S. 3(j) of the Patents Act, 1970 (which excludes plants/animals and essentially biological processes from patentable subject matter).
- Eisai v Dr. Reddy’s – one of the first decisions which dealt with the genus-species patents issue.
- Pharmacyclics v UOI – a decision where the Delhi High Court laid down comprehensive guidelines for the Patent Office to follow in post-grant opposition cases filed against patent applications.
- Christian Louboutin v Nakul Bajaj – first case where the Delhi High Court examined intermediary liability vis-à-vis trademark infringement.
- Louis Vuitton v Omi – in this decision, the Delhi High Court extensively dealt with principles relating to ‘contempt in the face of the Court’.
- Jatin Das v UOI – in this decision involving Moral Rights of an artist, the Court fashioned an innovative remedy balancing the rights of the artist and the opposing government undertaking which had torn down his sculpture.
- Cases enforcing the Personality Rights of Amitabh Bachchan and Anil Kapoor.
