In a final ex parte order the Delhi High Court confirmed Montblanc the owner of the MONTBLANC and MEISTERSTUCK marks and the Three Ring / Star Device, and granted a permanent injunction against the defendants.

The defendants, an e-commerce portal, were found to be copying, counterfeiting and marketing Montblanc’s products through their website. The bench accepted that the defendants habitually sold counterfeit products and on a complaint to the Cyber Cell, an FIR had been registered against them as well.

In an earlier case involving Cartier, the Delhi High Court had awarded Rs. 1 crore in damages against an e-commerce website, setting a new record.
